This statement describes the position of ssslither LLC, a Nevada limited liability company, operator of ssslither, with respect to the federal recordkeeping and labeling requirements at 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75.
ssslither is a private, invitation-and-approval social platform for adults. Members create profiles and communicate with each other. All photographs, videos, and audio on the service are uploaded by members, about themselves, and are transmitted only to the members they choose to share them with. Profiles are not public on the open web and are not indexed by search engines.
ssslither LLC does not create, produce, direct, film, commission, pay for, curate, or edit any depiction appearing on the service. It operates the systems that store and transmit what members upload.
With respect to all content on the service, ssslither LLC is not a “producer” as that term is defined at 28 C.F.R. § 75.1(c). Its activities are limited to the transmission, storage, retrieval, hosting, formatting, and translation of communications created by others, without selection or alteration of the content, which 28 C.F.R. § 75.1(c)(4) expressly excludes from the definition of producer.
ssslither LLC accordingly has no recordkeeping obligation under 18 U.S.C. §§ 2257 or 2257A for content uploaded by members, and maintains no such records. To the extent any material on the service is subject to those requirements, the obligation rests with the member who produced it.
Some members link adult content platforms to their profiles or use ssslither to arrange collaborations. As stated in Section 7 of our Terms, any member who produces sexually explicit depictions is solely responsible for their own compliance with 18 U.S.C. § 2257, including verifying and recording the age and identity of every performer. ssslither LLC is not the producer of that content, does not host it on the member's behalf, and is not the custodian of records for it.
Membership is restricted to persons 18 years of age or older. Every member represents and warrants their age on creating an account, accounts are individually reviewed before approval, and we terminate any account we believe belongs to a minor. Members further represent that every person depicted in anything they upload is an adult who consented to it.
Sexual content involving a minor is absolutely prohibited. Where we detect it or are notified of it, we preserve the relevant records, terminate the account permanently, and report to the National Center for Missing & Exploited Children and to law enforcement as required by 18 U.S.C. § 2258A.
